Ted Cruz: Legal Limit Report 4
Sure, a high-level IRS official left after the scandal erupted last year about the agency targeting conservative groups. But what good did it do?IRS officials admitted that groups with conservative leanings, especially with the words “tea party” or “patriot” in their names, had been targeted for special scrutiny, asked for “inappropriate” information, and had their applications for nonprofit status delayed on purpose.
[I]t appears the administration not only tried to delay and prevent conservative organizations from receiving their tax-exempt status prior to the 2012 election, but was also already planning new regulations that would stifle their political speech and potential criticism of the administration.Organizations on both the left and the right have warned that the proposed rules would be harmful to their communications with members and the public.
Judicial Watch Accuses IRS of Flouting Federal Rules: Asks Office of Management and Budget to Direct Treasury Department to Withdraw New IRS Anti-Tea Party Regs
The Obama administration’s Treasury Department and former IRS official Lois Lerner conspired to draft new 501(c)(4) regulations to restrict the activity of conservative groups in a way that would not be disclosed publicly, according to the House Committee on Ways and Means. The Treasury Department and Lerner started devising the new rules “off-plan,” meaning that their plans would not be published on the public schedule. They planned the new rules in 2012, while the IRS targeting of conservative groups was in full swing, and not after the scandal broke in order to clarify regulations as the administration has suggested. The rules would place much more stringent controls on what would be considered political activity by the IRS, effectively limiting the standard practices of a wide array of non-profit groups.“Don’t know who in your organizations is keeping tabs on c4s, but since we mentioned potentially addressing them (off -plan) in 2013, I’ve got my radar up and this seemed interesting…,” Treasury official Ruth Madrigal wrote in a June 14, 2012 email to Lerner and others obtained by Ways and Means and provided to The Daily Caller.Ways and Means chairman Rep. Dave Camp blasted the off-the-record plan during a hearing Wednesday with IRS commissioner John Koskinen, and called for the administration’s newly proposed 501(c)(4) rules to be halted until criminal investigations into the IRS targeting scandal are complete.
“If on the other hand, you’ve got an office in Cincinnati, an IRS office, that I think for bureaucratic reasons, is trying to sreamline a difficult law to begin with, and interpret whether a non-profit is a political organization, deserves a tax exempt agenc, ant they’ve got a list. Suddenly, everyone’s outraged… And, I’ll point out that there are some so-called progressives and perceived to be liberal commentators during that week that were just outraged at the possibility that these folks had in some way been discriminated against. And, that is what gets news.”
Last night, President Obama subverted a Justice Department investigation. Yeah, he did.During the back rub of an interview the president received from Chris Matthews Thursday night, Obama, while decrying the routine practice of journalism – it focuses on too many bad things, he whined – wandered into a declaration that the IRS targeted conservative groups for “bureaucratic reasons” – as opposed to a criminal reasons – and that agents weren’t intentionally singling out “Tea Party folks.”
If on the other hand, you’ve got an office in Cincinnati in the IRS office that I think for bureaucratic reasons is trying to streamline what a difficult law to interpret about whether non-profit is actually a political organization deserves a tax exempt agency , and they’ve got a list, suddenly everybody’s outraged. If this sounds like mere typical Obama indignation, let me remind you of something. The Justice Department is currently investigating whether crimes were committed by IRS officials in this affair.
By the way, Chris, I’ll point out that there are some called progressives perceived to be liberal commentators who during that week were just outraged at the possibility that these folks had been at the direction of the Democratic Party in some way discriminated against tea party folks. That is what gets news, what gets attention.
Well, the boss just gave you your answer. So please, do stand down.
ABC, CBS and NBC have so far refused to report the latest bombshell in the IRS scandal - a newly released list from the agency that showed it flagged political groups for “anti-Obama rhetoric.” On September 18 the USA Today, in a front page story, reported the following: “Newly uncovered IRS documents show the agency flagged political groups based on the content of their literature, raising concerns specifically about ‘anti-Obama rhetoric,’ inflammatory language and ‘emotional’ statements made by non-profits seeking tax-exempt status.”
Not only have ABC, CBS and NBC not reported this story they’ve flat out stopped covering the IRS scandal on their evening and morning shows. It’s been 85 days since ABC last touched the story on June 26. NBC hasn’t done a report for 84 days and CBS last mentioned the IRS scandal 56 days ago on July 24.
The article by Gregory Korte went on to report: “The internal 2011 documents, obtained by USA TODAY, list 162 groups by name, with comments by Internal Revenue Service lawyers in Washington raising issues about their political, lobbying and advocacy activities. In 21 cases, those activities were characterized as ‘propaganda.’ The list provides the most specific public accounting to date of which groups were targeted for extra scrutiny and why. The IRS has not publicly identified the groups, repeatedly citing a provision of the tax code prohibiting it from releasing tax return information.
”I'm sorry folks, but I am becoming more and more convinced that US democracy just doesn't work anymore either."
The reason, Morris says, is that Obama was following the IRS actions with an “obsessive, personal involvement.”
The Patient Protection and Affordable Care Act, the sweeping health-care law that Obama signed in 2010, asks state governments to set up health exchanges, and authorizes the federal government to provide tax credits to people who use those exchanges to get insurance. But most states have refused to establish the online marketplaces, and both the tax credits and many of the law’s penalties can’t go into effect until the states act.
Obama’s IRS has decided it’s going to apply the tax credits and penalties in states that refuse, even without statutory authorization. During the recent scandal over the IRS’s harassment of conservative groups, many Republicans have warned that the IRS can’t be trusted with the new powers that the health law will give the agency. They are wrong about the verb tense: It has already abused those powers.
