Can North Korea Be Re-Designated as 'State sponsor of Terrorism'? Should It? HT: 38north.org.

Given the March 8 statement by the Malaysian Prime Minister implicating the government of North Korea in the murder of Kim Jong Nam, it would seem to qualify as an act of state sponsored international terrorism under the law.

The use of a prohibited chemical weapon in an attack in a public area of another nation makes it particularly heinous. True, it is not of the same level of viciousness as North Korea’s past campaign of state sponsored terrorism. The victim was a single North Korean terminated apparently in Pyongyang’s Byzantine family power struggle, whereas in Pyongyang’s previous campaign of state sponsored terror, the targets were South Korean civilians and officials in large numbers.

This included a bomb attack in Rangoon that murdered a significant part of the ROK Cabinet and the bombing of a South Korean civilian airliner killing 115 people in the 1980s. Moreover, a single intra-family assassination does not necessarily meet the “repeated” support criterion for designation, but if the international outcry over the assassination is loud enough (e.g., through some decision of the UN Security Council), one suspects a means could be found to move forward. It would seem absurd to have to wait for Pyongyang to conduct a second VX attack in order to do so.

It is possible that the Secretary of State could simply conclude that the DPRK had violated assurances that permitted President Bush to lift the designation as a state sponsor, requiring him to re-designate Pyongyang; he could also consider North Korea’s recent cyber attacks on the US and South Korea as an act of state-sponsored terrorism.[4]

So, in all probability, the Secretary could designate North Korea. This might take a little time—even in this post-truth era—as sanctions decisions are fact-based and must meet legal and procedural standards. This will require some concrete, legal basis for concluding there was a definite North Korean government role in the assassination. The real issues are whether and when he should do it.


There are two strong reasons to do so.
The first is the heinous nature of the killing—particularly the use of a chemical weapon on the territory of a previously friendly country. 
The second is that the diplomatic context for removing the DPRK from the state sponsors list has evaporated. Prior to the assassination, the second reason was often given for returning North Korea to the list. It never gained traction largely because it did not give the Secretary any legal basis for such a step. But, now that there is an actual act of terrorism to consider, the lack of a diplomatic context for keeping North Korea off the list provides support for taking the step. It is hard to find a tactical basis for not taking the step when our previous nuclear dialogue is in a state of collapse. There is certainly a diplomatic logic to withdrawing what was, in fact if not in law, a concession made to Pyongyang in the context of progress on nuclear and missile issues now that the North Koreans are hell-bent on developing a strategic nuclear deterrent. As many as six NATO countries are prepared to send their ground-based, naval and air force units to the Black Sea area in 2017, NATO Secretary General Jens Stoltenberg said on Wednesday upon the completion of the first day of a conference of the North-Atlantic pact's defense ministers.

He said Canada, Germany, the Netherlands, Poland, Turkey, and the U.S. had confirmed their plans to dispatch units to Romania for a strengthening of NATO presense in the Black Sea area.

Specifically, he said 

  • Albania, Italy, Poland, and Slovenia will join the Canadian military already depoloyed in Latvia
  • Belgium, Croatia, France, Luxembourg, the Netherlands, 
  • and Norway will join the Germans in Lithuania. 
  • Denmark and France will send unit to pool with the Brits in Estonia, while Romania and Britain will augment the U.S. troops in Poland. Hmmm.....Putin should know better than to trust Erdogan. Read the full story here.

Turkey won’t take part in any future plan to stop migrants entering the European Union unless the bloc gives visa-free access to Turkish citizens, the country’s EU affairs minister said.

Turkey will continue to implement the current migration arrangement that helped slow the flow of refugees into Greece to virtually nothing, but “without visa liberalization Turkey won’t be part of any new mechanism,” Omer Celik told reporters in Bratislava, Slovakia, on Saturday.

“Turkey shouldn’t be expected to make any changes to its anti-terror law,” Celik said. “It’s about national security, Europe security.” He said Turkey could “make commitments” about changing its terrorism laws in the future but that would happen only once the country was no longer facing such a threat. National Party (UP) leader and Türk Solu weekly columnist Gökçe Fırat Çulhaoğlu –who is a graduate of Marmara University — has claimed that the signature of rector Ömer Faruk Baturel is different on his degree than President Recep Tayyip Erdoğan.

Making an online statement in front of the university’s Faculty of Business Administration through Periscope, Çulhaoğlu said: “I am also a graduate of this university. I received my degree; Erdoğan should also come and get it. … Marmara University Rector Ömer Faruk Baturel’s signature on Erdoğan’s degree is different from the signature on mine.”

Çulhaoğlu emphasized that Erdoğan says he started attending university in 1973, while the university says he was registered in 1974.

If he studied at the university between 1973 and 1981, as he says, then he studied for 7.5 years. However, maximum education period was 6 years back then. [If what he said was true], Erdoğan should have been expelled from the university in 1979,” he added.

University Faculty Association (ÜNİVDER) members also expressed their opinion on the issue, saying that Erdoğan has two-year license degree, however, he should have had a four-year license degree to become a president.

The claim that Erdoğan does not have a degree has long been discussed in Turkey. The Marmara University in İstanbul released a copy of Erdoğan’s diploma after the claim; however, the released diploma caused more doubts.

The released diploma named “School of Business Administration” as the department Erdoğan graduated from, however Erdoğan previously wrote in his CV that he graduated from “Faculty of Economics and Commercial sciences. The released diploma can now be reached online from Marmara University’s website.

Debates concerning the president’s graduation have started to increase lately.
People spoke about the controversial bachelor’s degree on social media, with hashtags #DiplomasıDaSahte (His diploma is also fake), #HaniMişDiploma (Where is the diploma) and #YaDiplomaYaİstifa (Either [show the] diploma or resign!) becoming trending topics in Turkey and world lists.
Last Friday, Marmara University rector Mehmet Emin Arat said in a written statement that Erdoğan was a graduate from the university and the allegations on the social media that Erdoğan does not actually have a degree were “unfair” and “baseless.”. Hmmm......Surely he did not attend university together with his BFF Obama?

The European Union is losing Turkey's trust by using double standards against the country, the TRT Haber news channel quoted Turkey's Foreign Minister Mevlut Cavusoglu as saying May 24.

He noted that Turkey has fulfilled 69 out of 72 commitments for achieving a visa-free regime with the EU.

"If the EU doesn't fulfill its commitments to Turkey, Ankara will refuse from fulfilling its obligations," said Cavusoglu.

The foreign minister believes that the EU should be sincere towards Turkey.

On May 4, the European Commission proposed the EU to cancel the visa regime with Turkey. Turkey cancelled the visa regime for the citizens of all the 28 EU countries on May 3, but the visa-free travel will be possible after the EU cancels the visa regime for Turkish citizens.

After cancellation of the visa regime, Turkish citizens will be able to stay without a visa for three months in Germany, Austria, Belgium, the Czech Republic, Denmark, Estonia, Finland, France, the Netherlands, Italy, Spain, Sweden, Switzerland, Iceland, Lithuania, Latvia, Luxembourg, Liechtenstein, Hungary, Malta, Norway, Poland, Portugal, Slovakia, Slovenia and Greece.

Earlier, President of the European Commission Jean-Claude Juncker said the EU may introduce a visa-free regime with Turkey in the autumn 2016 if Ankara implements all the necessary requirements.


An association agreement between the EU and Turkey was signed in 1963. Ankara filed an application for the EU membership in 1987, but the negotiations on Ankara's accession to the EU started only in 2005.

EU members have complained to Turkey for sending unwell Syrians to Europe as part of a controversial migrant swap deal, German daily Der Spiegel reported on Saturday.

Under a deal that came into force in March, the EU will resettle one Syrian refugee from camps in Turkey in exchange for each asylum seeker deported back to Turkey after arriving in Europe by boat.
So far around 400 people have been returned to Turkey under the deal, meaning in theory that 400 others have been resettled in Europe.

However, amid legal challenges to the deal, Der Spiegel's report suggests that tensions over the fine print could also be putting it at risk.

At a recent internal EU meeting in Brussels, a representative of Luxembourg reportedly criticised Turkey for sending “serious medical cases” as well as less-educated Syrians as part of the scheme.

Germany's parliamentary state secretary in the interior ministry, Ole Schroeder, also reported to the country's parliament this week that Turkey is not sending highly educated Syrians to Europe.

Turkey has informed UNHCR, the UN's refugee agency, that Syrian academics may not be included in the scheme and resettled to Europe.

UNHCR is usually in charge of identifying people eligible for refugee resettlement programmes, but in this case Turkey has insisted that it be in charge of selecting candidatesHmmmm.......From the start i warned that Turkey would 'select' them, this is the result. The proposed visa liberalization for Turkish citizens travelling to the EU could potentially have an impact on the terrorist risk in the EU in as far as the movement of terrorists of Turkish citizenship to and from the Schengen area is concerned, an extract from the report, seen by The Telegraph newspaper, reads.


Criminals could also take advantage of the unrestricted entry to the European Union to pursue their own goals, including through drug trafficking, importing illegal firearms and people smuggling into Europe, the report revealed.
"It can be expected that, as soon as Turkish citizens will obtain visa-free entry to the EU, foreign nationals will start trying to obtain Turkish passports in order to pretend to be Turkish citizens and enter the EU visa free, or use the identities of Turkish citizens, or to obtain by fraud the Turkish citizenship. This possibility may attract not only irregular migrants, but also criminals or terrorists," the report stressed.

Turkish President Recep Tayyip Erdogan on Sunday lashed out at Europe’s silence over the execution of a veteran Jamaat-e-Islami leader in Bangladesh, accusing the West of “double standards.”

If you are against political executions, why did you remain silent to the execution of Motiur Rahman Nizami who was martyred a couple of days ago,” Erdogan said in a televised speech in Istanbul.


Have you heard anything from Europe? … No. Isn’t it called double standards?” Erdogan said.

Nizami, leader of the Jamaat-e-Islami party, was hanged at a Dhaka jail late Tuesday. He was accused of ordering the killing of intellectuals during the 1971 conflict.

The 73-year-old former government minister was the fifth and the most senior opposition figure executed since the secular government in the overwhelmingly Muslim nation set up a controversial war crimes tribunal in 2010.

The 1971 conflict, one of the bloodiest in world history, led to the creation of an independent Bangladesh from what was then East Pakistan.

Since the beginning of the refugee crisis last year, the BKA has received some 369 tipoffs regarding either specific jihadi smugglers or people supporting a terrorist organization, German newspaper "Neue Osnabrücker Zeitung" reported on Wednesday.

According to statistics provided by the BKA, some 40 investigations have been opened against the suspects, with complaints including the membership in a terrorist organization and the preparation of a serious crime.

The BKA stressed that the threat of a terror attack Germany and Europe remains high.


"More attacks by Islamist terrorist cells cannot be ruled out," the BKA said, adding, however, that they currently have no concrete evidence of a planned attack.

 Politicians from Germany's Left party, however, have warned against anti-refugee "scaremongering."
The Left's domestic policy spokesperson in the Bundestag, Ulla Jelpke, said, "The possibility that individual IS-members - including trained assassins - could be among refugees mustn't lead to asylum seekers from Syria and Iraq generally being suspected of terrorism." Read the full story here.

Four followers of the Hizb ut-Tahrir terrorist organization have been detained in the city of Bakhchisarai in Crimea, the republic’s Prosecutor-General Natalya Poklonskaya told TASS on Thursday.

"Officers of the Crimea and Sevastopol department of the Russian Federal Security Service detained members of a terrorist organization and the organizer of this cell in the city of Bakhchisarai. Searches are underway," she said, adding that a criminal case was opened against three Bakhchisarai residents on charges of participating in a terrorist organization and one more person was charged with organizing terrorist activities.

"It has been established that one of those detained, being the leader of a local cell of the terrorist organization, has been engaged in secret anti-constitutional activities by means of conducting propaganda campaigns among local residents to recruit them to his terrorist organization and holding secret meetings," Poklonskaya said.

As many as six followers of Hiz ut-Tahrir have been detained in Crimea since the beginning of the year. The terrorist group was active in Crimea’s resort cities of Yalta and Alushta and maintained friendly relations with the Mejlis of the Crimean Tatars, a public movement outlawed in Russia.

Hizb ut-Tahrir al-Islami (Islamic Party of Liberation) is an international religious and political organization founded in 1953 in Jerusalem. Its goal is to remove all the non-Islamic governments and bring back the Muslims to the "truly Islamic life."

Russia’s Supreme Court banned Hizb ut-Tahrir in 2003 as a terrorist organization.

The EU-Turkey deal was "nothing more than a press communique", the lawyer said.
The legal arm of the European Parliament on Monday (9 May) spoke out against the EU deal with Turkey.

It noted the statement between the two on 18 March is nothing more than a press release, which has no legal bearing.

"This statement was nothing more than a press communique," the parliament lawyer told MEPs in the civil liberties committee. "This statement is not a binding agreement."

He noted the statement came without any signatures and was not published in the Official Journal of the European Union.

"It is very difficult to conclude that both the European Union and Turkey wanted to be legally bound under international law by this declaration," he said.

"It is really a long way from the drafting standards of any international agreement," he said.
Despite the lack of clarity behind the statement, it still conforms to EU law, he noted.

Baku accumulates armed forces in Nakhichevan with the aim to involve Turkey into conflict with Armenia. This opinion was voiced by Armenian experts. However, according to them, Turkey is expected to provide only indirect support, since NATO will keep the country from direct intervention in the conflict.

The "Caucasian Knot" has reported that at night of April 2, the situation in the Karabakh conflict zone was escalated. The parties to the conflict were engaged in combat actions with the use of tanks, multiple launch rocket systems, and aircrafts, which resulted in a large number of victims.

On April 5, the sides to the conflict declared a truce; however, they periodically accuse each other of violation of agreements on ceasefire. On May 6, Chairman of the National Assembly Standing Committee on Defence, National Security and Internal Affairs Koryun Nagapetyan told journalists in Yerevan that Azerbaijan had been accumulating military vehicles in Nakhichevan.

Azerbaijan is trying to play the card of Nakhichevan to provoke Turkey to intervene in the conflict. This was told to the "Caucasian Knot" correspondent by political analyst Ruben Megrabyan, an expert of the Armenian Centre for Political and International Studies.

Ruben Megrabyan did not rule out that in case of resumption of war in Nagorno-Karabakh, Azerbaijan will strike from the area of Nakhichevan deep into Armenia.
"The attack will be followed by a response of its armed forces, and that can provoke a Turkey's intervention in the conflict," Ruben Megrabyan has explained.
According to turkologist Levon Ovsepyan, Researcher of the Institute of Oriental Studies of National Academy of Sciences of Armenia, it is unlikely that Turkey will be directly involved in hostilities against Armenia. Although, according to Levon Ovsepyan, "the actions of the Turkey's authorities are unpredictable and aggressive enough."

Levon Ovsepyan believes that NATO can play a role in retention of the Turkey's intervention in the conflict. Meanwhile, according to the expert-turkologist, Turkey will support Azerbaijan indirectly, as it was repeatedly stated by Turkish politicians.

The German newspaper Bild has raised questions as to how Turkish President Recep Tayyip Erdogan’s children amassed their vast wealth, including one fortune worth tens of millions, when their father only earns some €50 thousand a year as head of state.

While their father [President Erdogan] earns some 50 thousand euro per year, his children bathe in luxury. Where does it come from? There is no official data on that account, the newspaper states.

The article then cites data published by Turkish opposition newspaper Cumhuriyet, which stated that everyone in Erdogan’s family, including his younger daughter, appear to be into business, dealing in such spheres as cosmetics, instant foods, the shipping industry, and jewelry.

The German newspaper notes that the net worth of one of Erdogan’s sons, Ahmet, amounts to some $80 million, with conflicting rumors concerning how he got this money. “A question is in order: does he get support from the [Turkish] government,” Bild writes.  

Bild also took note of last year’s discoveries published by the British news outlet, The Guardian, which uncovered information indicating that Turkish businessmen are actively involved in various deals with Islamic State (IS, formerly ISIL/ISIS) terrorists, such as illegal oil smuggling.

“One of them according to [The Guardian] data is Bilal Erdogan,” Bild points out.
Meanwhile, the Turkish government might soon see one of Erdogan’s family members join their family at the helm.

Erdogan has yet to appoint Davutoglu’s successor, but as the President will no doubt want his replacement to be more malleable, it is speculated that Erdogan’s son-in-law, Energy Minister Berat Albayrak, might have what it takes.Read the full story here.

Turkey won’t change its anti-terrorism laws to win visa-free travel to the EU for its citizens, President Recep Tayyip Erdogan has said.

"The EU at the moment is saying you will change your anti-terrorism law for visas," Erdogan said at a speech in Istanbul on Friday, according to AP.

"You allow terrorists to set up tents next to the European Parliament. Why don't you change your mindset?", Erdogan said, in an apparent reference to the Kurdistan’s Worker's Party (PKK). Symbols of PKK, which is designated as a terrorist organization in Turkey, had been seen on tents placed outside the European Parliament in March.

"We'll go our way, you go yours. Go make your agreement with whoever you can," Erdogan said, according to AP.

Earlier this week, the European Commission gave provisional backing for Turkish citizensto travel without visas for short stays in the EU’s passport-free Schengen areain return for Turkey stopping migrants reaching Europe. The Commission pegged its backing to the condition that Ankara met five more benchmarks to complete the bloc’s list of 72 criteria on Turkey’s visa liberalization roadmap by the end of June.

One of these outstanding tasks is to bring Turkish anti-terrorism legislation in line with European standards by narrowing its legal definition of terrorism. Erdogan, however, has been pressing for a broader definition of terrorism to fight a Kurdish insurgency in Turkey's southeastern regions and the threat of Islamic State group in Iraq and Syria. Critics, however, say that broader definition of terrorism is used by the government in Ankara to stifle dissent.

Prosecutors in the Turkish town of Izmir are studying the evidence to prove that Turkish ultranationalist Alparslan Celik is guilty of murdering Russian pilot Oleg Peshkov but have brought no official charge so far, Celik's lawyer Murat Ustundag told TASS on Friday.

"I have not received any official notification from the Prosecutors’ Office if official charges have been brought against my client or dropped. The prosecutors have not initiated any court proceedings against Celik on either of the charges. For the moment, the investigators are studying the existing evidence, including the Russian pilot episode, to decide if it can serve as ground for initiating criminal proceedings," Ustundag said adding that he and his colleagues were still waiting for the prosecutors’ decision.

"If the prosecutor’s office considers the existing evidence to be sufficient, it will open a criminal case. We have received no official notification to this effect so far," Ustundag said.

Some media reports which appeared earlier on Friday claimed that the prosecutors had cleaned Celik from a charge of murdering the Russian pilot.

Police arrested ultranationalist Alparslan Celik and another 14 suspects at an Izmir restaurant on March 30. The policemen took away several unregistered tommy-guns, a rifle and pistols from the suspects some of whom had recently returned from Syria where they had fought on the side of the militants. The local media distributed Celik’s confession in which he said it was he who killed Oleg Peshkov, the pilot of the downed Su-24 plane. However, the Turk changed his evidence when in custody. He said he was not personally involved in shooting at the Russian pilot and had never issued such orders.

A Turkish Air Force plane shot down a Su-24 Russian bomber on November 24 last year. The Ankara government claims that the plane violated the Turkish airspace. The Russian Defense Ministry says, in turn, that the Su-24 was in the sky over Syria. The crew ejected but one of the pilots, Oleg Peshkov, was killed by fire from the ground while he was descending on his parachute. The second pilot was saved and taken to a military base. Hmmm......I said a month ago that he wouldn't be charged......Anyone Surprised?

EU hopes to grant Turkey visa-free travel in migrant deal, but the U.K might Veto this 'madness'. (AA).

The European Union is set to give conditional approval on Wednesday for Turks to gain visa-free access to the Schengen zone, meeting a key demand by Ankara to keep a migrant crisis deal alive.
The European Commission, the executive arm of the 28-nation EU, will say Turkey must still meet further measures to access the passportless Schengen area without visas by June, sources told AFP on Tuesday.

Ankara has demanded that the visa requirement be scrapped in exchange for taking back migrants who land in Greece under a seal signed in March, but there are still widespread concerns among EU states, especially over human rights issues in Turkey.

"The Commission will put forward a plan to include Turkey in the list of countries exempted from visas," a European source told AFP, adding that "only 64 out of the 72 criteria are fulfilled" and that the offer, therefore, remains conditional.

Turkey has to meet a list of 72 criteria – ranging from biometric passports to respect for human rights – that were set when Brussels and Ankara first talked about 90-day visa-free travel to the Schengen area.

EU member states and the European Parliament must still approve the Turkey visa plan after it clears the Commission, which is by no means a foregone conclusion.

Germany and France have proposed an emergency brake or "snap back mechanism" under which it could halt visa-free travel if large numbers of Turks stay in the EU illegally or if there are a large number of asylum applications by Turks.

Even politicians in favor of EU membership, such as Home Secretary Theresa May,have signalled that further enlargement needs to be reconsidered for countries with "poor populations and serious problems with organised crime, corruption and sometimes even terrorism".
Ministers have emphasised that the UK has the right of veto over future prospective members, while insisting the talks with Turkey and other countries are unlikely to be rushed and, as such, the issue will not come to a head for a while.

Last month, George Osborne said a Turkish agreement was "not on the cards any time soon" and insisted the UK would not allow any free movement deal with countries which weren't closely aligned in terms of size and prosperity . Hmmm.....Once again the U.K. can make the difference and stand for freedom.

Along with judicial, tax and immigration issues, a Euro-army has for long been one of the main irritants of anti-EU campaigners. 

The fact that Germany - the powerhouse of the project - is mooting one so close to the referendum on whether Britain stays or goes is seen as madness by politicians fighting to keep the UK within the group.
Now a white paper has been drawn up by Berlin. Media reports suggest that the Germans wanted to keep its proposals secret until after the June 23 plebiscite but it has now been leaked.
The paper outlines steps to "gradually co-ordinate Europe's patchwork of national militaries and launch permanent cooperation under common structures among the member states."

The initiatives proposed includes strengthening cyberwarfare abilities and relaxing Germany's self-imposed restrictions about deploying troops in peacetime within the country.  This was brought in after 1945 when Nazism was crushed and Germans turned away from militarism.

The draft proposal seeks to end the ban noting the "character and dynamic of current and future security-political threats."  This includes deep-rooted fears in Germany that it could suffer a Paris-style terror strike any time soon.

"German security policy has relevance — also for beyond our country. Germany is willing to join early, decisively and substantially as a driving force in international debates ... to take responsibility and assume leadership," the white paper says.

Moscow’s suspicions of such a move will be compounded by Juncker’s specific statement that forming such a body would make clear to Russia that the EU is “serious about upholding the value of the European Union”.

Juncker insisted the force would not be in competition with Nato, the 28-member alliance which includes most but not all EU countries and which the UK views as the bedrock of western defence cooperation.

 Dutch Foreign Minister Bert Koenders has warned the Netherlands cannot guarantee the safety of citizens travelling to Turkey if they have been critical of Turkish leaders.
The warning, made during a parliamentary debate on Tuesday, comes as the Dutch government is working to lift a travel ban on Dutch-Turkish journalist Ebru Umar who was briefly arrested over the weekend for tweeting comments critical of President Recep Tayyip Erdogan.
But asked Tuesday in the Dutch parliament if he could provide guarantees for Dutch or Dutch-Turkish citizens travelling to Turkey on holiday who may have criticised Erdogan on social media, he said "no".
"There are no guarantees," Koenders insisted. "We have just had a case showing exactly what can happen. That is why we are working on it. But I cannot give any guarantees."

He also delivered a sharp warning to Turkey that "if it wants to step closer to Europe, it must significantly improve its behaviour."
"Let's be honest. You can't treat the press and press freedom this way, if you want to be part of Europe."

On Monday, the daily De Telegraaf published a large front page cartoon entitled "The long arm of Erdogan" depicting an ape with the Turkish leader's face crushing a woman resembling Umar.

Trials in Turkey for insulting Erdogan have multiplied since his election to the presidency in August 2014, with nearly 2,000 such cases currently open.
